CGT PD Pty Ltd, trading as CGT People & Development (CGT, we, us or our), respects the privacy of the people and organisations we work with.

We provide recruitment, workforce, HR and business support services, including services to Registered Training Organisations (RTOs) and other Australian businesses.

This Privacy Policy explains how we collect, use, store, disclose and protect personal information.

We aim to handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) where they apply to us. We also use these principles as a guide to good privacy practice in our day-to-day operations.

Section 02Personal information we may collect

The information we collect depends on how you interact with us.

It may include:

  • your name
  • email address
  • telephone number
  • residential area, state or work location
  • organisation and job title
  • employment and work history
  • qualifications, certificates and licences
  • professional memberships
  • skills and industry experience
  • training and assessment credentials
  • areas or units you are qualified or experienced to deliver
  • evidence of industry currency or professional development
  • preferred work arrangements and availability
  • résumé or CV information
  • referee details and references
  • information provided during interviews or screening
  • correspondence and enquiries
  • information required to provide HR, recruitment or business support services
  • records of our dealings with you.

Where reasonably required for a particular role or service, we may also collect information about:

  • identity and work rights
  • background or licence checks
  • criminal history where a check is lawful and relevant to the role
  • health, disability or other information that may be considered sensitive information.

We will only seek sensitive information where it is reasonably necessary for our work and where collection is permitted by law, including where your consent is required.

Section 03How we collect information

We normally collect personal information directly from you.

This may happen when you:

  • complete a form on our website
  • register your interest in work
  • send us your résumé or other documents
  • email or telephone us
  • speak with one of our team
  • attend an interview or meeting
  • apply for a position
  • provide qualifications or supporting evidence
  • engage us to provide recruitment, HR or business support services.

We may also receive information from other sources where appropriate, including:

  • employers or prospective employers
  • referees nominated by you
  • RTOs and other clients
  • recruitment or professional platforms
  • qualification or licence issuing bodies
  • publicly available professional information
  • government or regulatory bodies where permitted
  • service providers assisting us with our business.

Where practicable, we will tell you when information is being collected from another source.

Section 04Why we collect and use personal information

We may collect, hold and use personal information to:

  • respond to enquiries
  • provide our services
  • register candidates who are interested in work
  • understand a candidate's skills, experience and preferences
  • identify suitable employment or contract opportunities
  • assess suitability for a particular role
  • contact candidates about possible work
  • conduct interviews and candidate screening
  • verify qualifications, credentials, licences or experience where appropriate
  • obtain references with appropriate authority
  • prepare candidate shortlists
  • support recruitment decisions
  • provide HR and workforce support
  • communicate with clients and candidates
  • manage our business relationships
  • maintain appropriate business and compliance records
  • comply with applicable legal or regulatory requirements
  • investigate complaints or concerns
  • protect our legal rights and the rights of others.

We will not use personal information for an unrelated purpose unless you have consented or the use is otherwise permitted or required by law.

Section 05Candidates and our recruitment network

If you register with CGT People & Development, we may keep your information on our candidate or workforce register so we can contact you when suitable opportunities arise.

This may include your:

  • contact details
  • résumé
  • qualifications
  • licences
  • work experience
  • industry experience
  • training and assessment credentials
  • industry currency information
  • availability
  • location
  • preferred type of work.

Registering with us does not guarantee employment, placement, an interview or an offer of work.

Sharing your information with an employer

We may discuss an opportunity with you before presenting your personal information or résumé to a prospective employer or client.

We will not normally send your identifiable candidate profile or résumé to a prospective employer without first obtaining your agreement to be considered for that opportunity.

Once you agree, relevant information may be provided to that organisation so it can assess your suitability.

The receiving organisation may have its own privacy obligations and privacy policy.

Section 06RTO, trainer and assessor information

CGT People & Development provides recruitment and workforce support to organisations in the vocational education and training sector.

Where we are assisting an RTO, we may collect, review or help verify information relating to trainers, assessors and other personnel.

This may include:

  • training and assessment credentials
  • vocational qualifications
  • licences
  • statements of attainment
  • employment history
  • industry experience
  • evidence of vocational competency
  • industry currency
  • professional development
  • professional memberships
  • supporting evidence relevant to the person's proposed role.

This information may be provided to an RTO where you have agreed to be considered for a role, where the information has been collected as part of services we are providing to that RTO, or where disclosure is otherwise authorised or required.

Information may assist an RTO to meet its workforce, trainer and assessor, governance, recordkeeping or regulatory responsibilities under applicable VET legislation and standards.

CGT People & Development is a recruitment, HR and business support provider. Unless expressly stated otherwise, CGT People & Development is not acting as the RTO and does not replace an RTO's responsibility for making its own compliance, employment, credential or engagement decisions.

Where legally required or appropriately authorised, information relating to work performed for an RTO may also need to be made available to a regulator, government agency, auditor or other authorised body, including the Australian Skills Quality Authority (ASQA).

Section 07Sensitive information

Some recruitment or HR activities may involve sensitive information.

Sensitive information may include information about a person's:

  • health or disability
  • racial or ethnic origin
  • professional or trade association membership
  • criminal record
  • other matters defined as sensitive information under privacy law.

We will not ask for sensitive information merely because it may be useful.

Where sensitive information is required, we will only collect it where reasonably necessary and where permitted by law, including obtaining consent where required.

Please avoid including unnecessary sensitive or highly confidential information in an enquiry form or résumé.

Section 08Who we may disclose information to

Depending on the circumstances, personal information may be disclosed to:

  • employers or prospective employers, with appropriate authority
  • RTOs or other clients we are supporting
  • referees
  • qualification, licence or credential verification bodies
  • professional advisers
  • IT, email, cloud storage and business system providers
  • website and form service providers
  • contractors assisting us to provide our services
  • insurers
  • auditors
  • legal or professional advisers
  • regulators and government authorities where required or authorised by law
  • law enforcement bodies where legally required.

We only disclose information that is reasonably required for the relevant purpose.

We do not sell candidate contact details or résumés as marketing lists.

Section 09Service providers and overseas data

We may use third-party systems and service providers for functions such as:

  • website hosting
  • email
  • cloud file storage
  • database or customer relationship management systems
  • online forms
  • document management
  • communications
  • analytics
  • cybersecurity and IT support.

Some providers may store or process information using infrastructure located outside Australia.

Where personal information may be disclosed to an overseas recipient, we will take reasonable steps appropriate to the circumstances to protect that information and meet any applicable requirements under Australian privacy law.

Where it is practicable for us to identify the countries in which overseas recipients are located, this Privacy Policy will be updated accordingly.

Section 10Website information, cookies and analytics

When you use our website, technical information may be collected automatically.

This can include:

  • date and time of access
  • pages visited
  • referring website
  • general website usage information.

Our website or service providers may use cookies or similar technologies to operate the website, maintain security, understand website usage and improve our services.

We may contact clients, prospective clients or other contacts about services, opportunities or information that may be relevant to them where we are permitted to do so.

Where Australian electronic marketing laws apply, we will take reasonable steps to ensure commercial electronic messages are sent with appropriate consent or another lawful basis and include a way to unsubscribe.

You may ask us at any time to stop sending marketing communications.

A request to stop marketing will not prevent us from contacting you about an existing enquiry, candidate registration, engagement, contract or other service-related matter.

Section 12How we protect personal information

We take reasonable steps to protect personal information from:

  • misuse
  • interference
  • loss
  • unauthorised access
  • unauthorised modification
  • unauthorised disclosure.

Depending on the information and system involved, protections may include access controls, passwords, secure systems, staff access restrictions, backups, security monitoring and appropriate procedures.

No online system, email service or electronic storage method can be guaranteed to be completely secure.

For that reason, please do not send highly sensitive information through a general website enquiry form unless we have asked you to do so.

Section 13How long we keep information

We keep personal information only for as long as reasonably required for the purpose for which it was collected, our ongoing business needs, or an applicable legal, contractual, insurance, audit or regulatory requirement.

Candidate information may be retained while you remain interested in being contacted about suitable opportunities.

You may ask us to remove your information from our active candidate register.

Where we no longer require personal information, we will take reasonable steps to securely destroy it or de-identify it, unless we are required or reasonably permitted to retain it.

A request for deletion does not necessarily require us to delete information that must be retained for legal, regulatory, contractual, dispute management or other lawful purposes.

Section 14Keeping your information accurate

We take reasonable steps to keep personal information accurate, complete, relevant and up to date for the purpose for which it is used.

Candidates should let us know if their:

  • contact details
  • qualifications
  • licences
  • employment
  • availability
  • industry currency
  • work preferences

change.

Section 15Accessing or correcting your information

You may contact us to request access to personal information we hold about you or ask us to correct information that is inaccurate, incomplete or out of date.

We may need to verify your identity before providing access or making a change.

In some circumstances, access may be restricted or refused where permitted by law. If that happens, we will explain the reason where we are legally able to do so.

Section 16Withdrawing from our candidate network

If you no longer want CGT People & Development to contact you about work opportunities, you can ask us to remove you from our active candidate network.

We will stop using your information for candidate matching unless there is another lawful reason for us to retain or use particular records.

Some information may need to be retained for legal, contractual, compliance, audit or dispute management purposes.

Section 17Privacy breaches and data incidents

If we become aware of a suspected loss, unauthorised access or unauthorised disclosure of personal information, we will assess the incident and take appropriate steps to contain and respond to it.

Where the Notifiable Data Breaches scheme or another legal notification requirement applies, we will take the steps required by law, including notifying affected individuals and the Office of the Australian Information Commissioner where required.

Our website may contain links to websites or services operated by other organisations.

We are not responsible for the privacy practices of those organisations. You should review their privacy information before providing them with personal information.

Section 20Automated decision-making

We do not currently use a computer program to make solely automated decisions about candidates that would reasonably be expected to significantly affect their rights or interests.

Technology may be used to organise information, search candidate records or assist our staff, but recruitment and candidate decisions involve human review.

If our practices change, we will update this Privacy Policy and provide any additional information required by applicable privacy law.

Section 21Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to:

  • our services
  • our systems
  • the way we handle information
  • our service providers
  • applicable laws or regulatory requirements.

The latest version will be published on our website and will show the date it was last updated.
